The critical CBP deadline most importers don't know they have
The Legal Basis
Under 19 U.S.C. § 1514, an importer has 180 days from the date of liquidation to file a protest with CBP. A protest is the formal mechanism for contesting duties paid on a finally-liquidated entry — including IEEPA tariffs.
Why It Matters Now
IEEPA tariffs were imposed beginning in early 2025. Entries liquidated in April–May 2025 are reaching their 180-day deadline now. Once the window closes, the entry is final and no recovery path remains under CBP protest procedures.
Phase 3 vs. Protest
CAPE Phase 3 (open Oct 6, 2026) is available only to CIT-plaintiff importers with IOR submitted to CBP by July 30, 2026. If you are not a named plaintiff in the Freestyle World litigation, the 180-day protest is your primary path.
Where to Find Your Date
Your entry liquidation date appears on CBP Form CF-4333 (the liquidation notice), in ACE under Entry Summary > Entry Details, or on your Form 7501. Your customs broker can also confirm the liquidation date for each entry.
