How CAPE Works
Brazil: Steel, Agriculture, and Aviation Exposure
Brazil is a major U.S. import source for steel products, agricultural commodities (soybeans, orange juice, coffee, beef), commercial aircraft components (Embraer), ethanol, and specialty chemicals. The IEEPA tariff orders hit Brazilian goods at the standard rate, on top of any pre-existing Section 232 duties on steel and aluminum. The Federal Circuit ruling covers all IEEPA duties collected, and CBP is processing Brazil importer refunds through CAPE.
CAPE Phase 3, which opened October 6, 2026, extends refund eligibility to finally liquidated entries — a critical expansion for Brazilian steel and agricultural importers, most of whose 2025 entries are now in finally liquidated status.
Top Import Categories from Brazil Affected
- Steel products — hot-rolled, cold-rolled, wire rod (HTS Chapter 72)
- Soybeans and agricultural commodities (HTS Chapters 12, 23)
- Orange juice and processed citrus products (HTS Chapter 20)
- Commercial aircraft components and Embraer parts (HTS Chapter 88)
- Ethanol and biofuels (HTS Chapter 22)
- Coffee (HTS Chapter 9)
- Beef and poultry products (HTS Chapter 2)
- Specialty chemicals and resins (HTS Chapters 28–29)
Key Issues for Brazil Importers
Steel 232 + IEEPA Overlap
Brazilian steel was already subject to Section 232 steel tariffs (with quota provisions) before IEEPA was added. Only the IEEPA increment is refundable — we isolate the correct refund amount by entry and duty program.
Agricultural Commodity Pricing
Brazilian agricultural entries often involve variable price adjustments and multiple shipments per entry. We work with your customs broker to ensure the dutiable value used in the CAPE refund calculation reflects the actual IEEPA duty paid on each commodity shipment.
Aviation Components
Embraer parts and commercial aircraft components from Brazil may qualify for temporary importation or duty drawback programs that interact with CAPE. We review each aviation entry for the most advantageous refund pathway.
Our Brazil Refund Recovery Process
Step 1: Commodity and Sector Audit
We identify all Brazilian-origin entry summaries by commodity sector — steel, agriculture, aviation, chemicals — and calculate total IEEPA duty exposure by HTS code. Steel entries go through a 232/IEEPA segregation review before CAPE filing.
Step 2: Liquidation and Phase Classification
Entries are classified by CAPE phase eligibility — finally liquidated (Phase 3), unliquidated (earlier phases), or protest-eligible. Brazil importer entries from early 2025 are predominantly in finally liquidated status, making Phase 3 the critical filing track.
Step 3: CAPE Filing and Disbursement
All filings are coordinated with or executed through a licensed customs broker in accordance with 19 C.F.R. Part 111. We prepare the complete CAPE submission package and manage all CBP correspondence through final disbursement.
