Switzerland: Pharma, Watches, and Precision Instruments

Switzerland is a top-ten U.S. import source by value, and its export profile is uniquely concentrated in high-value, low-volume categories. Novartis, Roche, and Lonza ship finished pharmaceuticals and biologics that routinely generate the highest per-entry IEEPA duty figures of any European exporter. Alongside pharma, Swiss exports include luxury and precision watches (Rolex, Swatch Group, Richemont brands), precision surgical instruments and medical devices (Straumann, Sonova, Hamilton Medical), specialty chemicals, and high-end machinery. IEEPA tariffs applied across all these categories, and the Federal Circuit has ordered them refunded.

The defining challenge for Switzerland CAPE claims is related-party transfer pricing. The majority of Swiss pharmaceutical imports enter through U.S. affiliates of Swiss parent companies, with intercompany pricing subject to IRS and CBP scrutiny. The IEEPA duty refund basis must be computed from the correct dutiable value, which requires careful review of the original entry documentation and any First Sale elections.

Key Issues for Switzerland Importers

Related-Party Transfer Pricing

Most Swiss pharmaceutical entries involve related-party transactions between Swiss parent companies and U.S. affiliates. Dutiable value in these entries may reflect intercompany pricing that requires reconciliation against arm’s-length benchmarks. We review original declared values and First Sale elections to establish the correct IEEPA refund basis under CAPE.

Watch and Instrument Valuation

High-value Swiss watch imports — particularly luxury mechanical movements and completed watches — carry large per-unit IEEPA duty figures. Entries with complex assembly chains (movements from one source, cases from another, assembly in Switzerland) require HTS classification review to confirm country-of-origin and the correct CAPE refund amount.

Biologics and Specialty Drug Classification

Biologic drugs (monoclonal antibodies, cell therapies, recombinant proteins) shipped from Swiss manufacturing facilities may classify under different HTS headings than small-molecule pharmaceuticals. Classification at the Chapter 29/30 boundary directly determines the applicable IEEPA rate and the CAPE refund amount. We audit classification before filing.

Our Switzerland Refund Recovery Process

Step 1: Pharma and High-Value Entry Audit

We compile all Swiss-origin entry summaries, prioritizing pharmaceutical and biologic entries by IEEPA duty exposure. We review declared values, First Sale elections, and related-party pricing documentation to confirm the correct duty basis for each entry.

Step 2: Classification and Valuation Review

Watch and instrument entries are reviewed for HTS classification accuracy and country-of-origin documentation. Biologics are audited for correct classification at the Chapter 29/30 boundary. Every entry cleared through this review is packaged for CAPE Phase 3 submission.

Step 3: CAPE Filing and Disbursement

All filings are coordinated with or executed through a licensed customs broker in accordance with 19 C.F.R. Part 111. We prepare the complete CAPE submission package for each eligible entry and manage all CBP correspondence through final disbursement.
