UK IEEPA Tariff Refund Recovery
Recover IEEPA Duties Paid on British Imports
The United Kingdom exports aerospace components, pharmaceuticals, premium vehicles, Scotch whisky, and financial services technology to the United States — categories with significant IEEPA duty exposure per entry. A federal court ordered those duties refunded. CAPE Phase 3 is live as of October 6, 2026.

How CAPE Works
UK: Aerospace, Pharma, Vehicles, and Scotch
The United Kingdom is among the United States’ most significant trading partners. UK exports to the U.S. include Rolls-Royce jet engines and aerospace components, branded pharmaceuticals (AstraZeneca, GSK), premium and luxury vehicles (Jaguar Land Rover, Bentley, Rolls-Royce Motorcars, MINI), Scotch whisky and gin, specialty chemicals, and advanced defense electronics (BAE Systems, Cobham). IEEPA tariffs applied across all these categories, and the Federal Circuit has ordered them refunded. CAPE Phase 3 — covering finally liquidated entries — launched October 6, 2026.
Brexit introduced a new layer of country-of-origin complexity for UK imports: goods manufactured using EU components or processed within the EU before final finishing in the UK may not qualify as UK-origin under CBP substantial-transformation rules. We audit origin documentation on every UK entry before CAPE submission to confirm eligibility and protect against post-refund CBP audit exposure.
Top Import Categories from the UK Affected
- Jet engines, aerostructures, and aerospace components — Rolls-Royce, BAE Systems (HTS Chapter 88)
- Branded pharmaceuticals and biologics — AstraZeneca, GSK (HTS Chapter 30)
- Premium and luxury automobiles — Jaguar, Land Rover, Bentley, Rolls-Royce Motorcars (HTS Chapter 87)
- Scotch whisky, gin, and premium spirits (HTS Chapter 22)
- Specialty chemicals and advanced materials (HTS Chapters 28–29, 38)
- Defense and security electronics — Cobham, Ultra Electronics (HTS Chapter 85)
- Precision instruments and medical devices (HTS Chapter 90)
- Ceramics, fine china, and luxury consumer goods (HTS Chapters 69, 71)
Key Issues for UK Importers
Post-Brexit Country-of-Origin Review
Since Brexit, goods that use EU components or undergo processing in the EU before final manufacture in the UK face heightened CBP country-of-origin scrutiny. We audit origin documentation for every UK entry to confirm substantial transformation occurred in the UK and that the CAPE claim will withstand CBP audit review after disbursement.
Aerospace and Defense Entry Valuation
Rolls-Royce jet engine and BAE Systems defense-electronics entries frequently involve long-term contracts, progress payments, and government-to-government supply arrangements that affect dutiable value. We reconstruct the correct IEEPA duty basis for each aerospace and defense entry before CAPE submission.
Scotch Whisky and Spirits Classification
Scotch whisky, gin, and premium UK spirits entries classify under HTS Chapter 22 subheadings by type, alcohol content, and container size. Misclassification affects the IEEPA duty basis. We audit HTS subheading classification for all spirits entries to ensure the correct refund amount is claimed under CAPE.
Our UK Refund Recovery Process
Step 1: Origin and High-Value Entry Audit
We compile all UK-origin entry summaries and prioritize by IEEPA duty exposure. Aerospace and pharmaceutical entries are first reviewed. Every entry undergoes origin documentation review to confirm UK substantial transformation and CAPE eligibility, with particular attention to goods that involve EU supply-chain inputs post-Brexit.
Step 2: Valuation, Classification, and Spirits Review
Aerospace and defense entries are reviewed for correct dutiable value under long-term contract structures. Spirits entries are audited for correct HTS subheading classification by spirit type, ABV, and container size. Vehicle entries are reviewed for correct Chapter 87 classification and any Section 232 interaction. Every entry cleared through this review is packaged for CAPE Phase 3 submission.
Step 3: CAPE Filing and Disbursement
All filings are coordinated with or executed through a licensed customs broker in accordance with 19 C.F.R. Part 111. We prepare the complete CAPE submission package for each eligible entry and manage all CBP correspondence through final disbursement.
